Who we are
These terms cover the services of TechOnTouch, proprietorship of Ashit Jitendra Shah, GSTIN 27GBFPS9684N1ZD, 20/24, Room no. 15, Old Hanuman Lane, Mumbai, Maharashtra 400002, India ("TechOnTouch", "we", "us"). By asking us to start work or paying an invoice, you ("the client") agree to these terms. A written quote or agreement for a specific project takes priority over these terms where the two differ.
Our services
We design and build websites, build and fix online stores, and build apps. We also offer a yearly care plan covering the domain, hosting and small changes. What is included in each project is set out in the quote we send you before any payment.
Free preview
For many website projects we build a first version before you pay, so you can see it on a link. The preview is free and places you under no obligation. If you do not go ahead, we take the preview down and you owe nothing.
Quotes, invoices and payment
We do not publish prices. The price for your project is the one in your written quote, agreed before you pay anything. Invoices to clients outside India are issued and charged in US dollars. Clients in India are quoted and invoiced in rupees, and GST is added where it applies.
The one time fee is due before the site goes live on your domain, unless your quote says otherwise. The care plan fee is paid yearly in advance.
You can pay by international credit or debit card through a secure payment link or invoice from Razorpay, our payment provider, or by bank transfer where we offer it. We never see or store your full card details. Your bank may convert the US dollar charge to your own currency at its own rate and may add its own fees. Those are set by your bank, not by us.
Your content
You are responsible for the text, photos, logos and other material you give us, and for having the right to use it. We may use licensed or openly licensed fonts, images and code in your site; these remain under their own licences.
Changes and delivery
One or two rounds of changes before launch are included unless your quote says otherwise. Delivery dates we give are estimates. If a date slips, we will tell you why and when to expect the work.
Delivery
We deliver websites and apps digitally. Nothing is shipped. We send you a link to the finished site, and we publish it on your domain once you approve it and the one time fee is paid. Our Shipping and delivery policy gives the timelines.
Support
Write to ashit@techontouch.in, Monday to Friday, 10:00 to 18:00 India time. We reply within 2 working days. Care plan requests are answered within 2 working days and finished in the order received.
Ownership
Once the one time fee is paid in full, the finished site and the content made for it belong to you.
Domains we register for you are registered in your name. If you leave, we will help you move the domain and site files to another provider.
We may show the finished work in our portfolio. If you would rather we did not, or want your business name left out, tell us and we will respect that.
Care plan
The care plan runs for twelve months from the date it starts. We email you a renewal invoice at least 14 days before it ends. It renews only if you pay the care plan fee in your quote.
It covers domain registration and renewal, hosting, security updates and small changes on request. Larger changes are quoted separately.
You can cancel at any time by writing to us. Refunds for the unused part of the year are covered in our Cancellation and refund policy.
Third party services
Sites depend on services run by others, such as hosting companies, domain registrars, Shopify and payment providers. We choose reputable providers but are not responsible for their outages, price changes or policies.
Limitation of liability
We take care over every project, but we cannot promise that a site will be free of every error or always available. To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the twelve months before the claim, and we are not liable for indirect losses such as lost profit or lost data.
Ending a project
Either side may end a project by written notice. You pay for work completed up to that point, as set out in the refund policy. If we end a project without cause, we refund any fee paid for work not yet delivered.
Governing law and disputes
These terms are governed by the laws of India. If you have a complaint, write to ashit@techontouch.in and we will reply within 2 working days. If we cannot settle it within 30 days of your first message, either side may take it to the courts at Mumbai, Maharashtra, which have exclusive jurisdiction. Nothing here stops you from disputing a card charge with your card issuer.
Changes to these terms
We may update these terms. The date at the top shows the latest version. Work already paid for stays under the terms that applied when you paid.
